Refund and Returns Policy
The owner of the online store UHUUCLUB.EU (hereinafter referred to as the Online Store) is Uhuu Club OÜ (registration code 14518752, located at Turu 34b, Tartu, Tartumaa, 51004).
Validity of the Sales Agreement, Product, and Price Information
The sales terms apply when purchasing goods from the Online Store.
Prices for the products sold in the Online Store are indicated next to the products. The price includes a fee for the delivery of goods.
The delivery fee depends on the buyer’s location and the chosen delivery method. The delivery fee is displayed to the buyer during the order process.
Information about the products is provided directly next to the products in the Online Store.
Placing an Order
To order a product, add the desired products to the shopping cart. To complete the order, fill in the required fields and select the appropriate delivery method. The total cost will then be displayed, which can be paid via a bank link or other payment solutions.
The contract is effective upon receipt of the payment into the Online Store’s bank account.
If it is impossible to deliver the ordered goods due to their unavailability or any other reason, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded immediately, but no later than 14 days after sending the notification.
Delivery
Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Finland.
The buyer covers the shipping costs, and the corresponding price information is displayed alongside the shipping method.
Domestic shipments within Estonia generally reach the buyer’s specified destination within 2-4 business days after the sales agreement becomes effective. Shipments outside Estonia within 4-8 days.
In exceptional cases, the right is reserved to deliver the goods within 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods must not be used in any way other than necessary to ascertain the nature, characteristics, and functioning of the goods as would be allowed in a physical store.
If the goods have been used for purposes other than necessary to ascertain their nature, characteristics, and functioning, or show signs of use or wear, the Online Store has the right to reduce the refund in proportion to the decrease in the value of the goods.
To return the goods, a withdrawal request must be submitted, the form for which can be found here: withdrawal form, and sent to the email address uhuu@uhuuclub.eu no later than 14 days after receiving the goods.
The buyer bears the cost of returning the goods, except when the reason for the return is that the item does not correspond to what was ordered (e.g., wrong or defective item).
The buyer must return the goods within 14 days of submitting the withdrawal notice or provide proof that the goods were handed over to the courier during this period.
Upon receiving the returned goods, the Online Store will promptly refund the buyer but no later than 14 days after receiving the withdrawal notice, all payments received under the contract.
The Online Store may withhold refunds until the goods being returned are received or until the buyer provides proof that the goods have been returned, whichever occurs first.
If the buyer explicitly chooses a delivery method other than the cheapest standard method offered by the Online Store, the Online Store is not obliged to refund the costs exceeding the cost of the standard delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the Online Store has been mistakenly listed significantly below the market price.
Right to File a Complaint
The Online Store is responsible for any non-conformity of the goods sold to the buyer or defects that existed at the time of delivery and that become apparent within two years of delivery to the buyer. During the first six months, it is presumed that the defect existed at the time of delivery. The burden of disproving this presumption lies with the Online Store.
The buyer has the right to notify the Online Store of any defects no later than two months after discovering them by sending an email to uhuu@uhuuclub.eu.
The Online Store is not responsible for defects that arise after the goods have been delivered to the buyer.
If the product purchased from the Online Store has defects for which the Online Store is responsible, the Online Store will repair or replace the defective product. If the product cannot be repaired or replaced, the Online Store will refund the buyer for all fees incurred under the sales agreement.
The Online Store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 14 days.
Direct Marketing and Processing of Personal Data
The Online Store uses the personal data entered by the buyer (including name, phone number, address, email address, and bank details) only for processing the order and sending the goods to the buyer. The Online Store will forward personal data to the logistics company in order to deliver the goods.
The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed a wish by entering their email address on the website and indicated their desire to receive direct mail notifications.
The buyer can unsubscribe from offers and newsletters sent to their email at any time by notifying us via email or following the instructions in the promotional email.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, they should be sent to uhuu@uhuuclub.eu.
If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can contact the Consumer Disputes Committee. You can review the procedure and submit a complaint here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract between the buyer and the Online Store. The buyer’s complaint review in the committee is free of charge.
The buyer may also turn to the European Union’s online dispute resolution platform.
